This man has never paid a cent in child support. The child is now 18 yrs old however the child has a disability that he recieves SSIDI for also. He’s a full time student and is enrollrd in special education classes. Does this father owe back child support? Is there a way of collecting this? Or is the child entitled to some sort of benefits through his fathers SSIDI?

Receiving SSI disability does not automatically exempt a person from paying child support. There may be other reasons, not mentioned in your question, why he is not required to pay child support. However, in and of itself, the fact that he receives child support is not a reason for him not to be required to pay child support.

Absolutely, the father is responsible for whatever the court said he was responsible for, from the time of the court order, until the child began receiving social security support payments – either social security for a child of a disabled adult, or direct disability.

There’s probably no way to collect it, however – that SSDI payment isn’t “attachable”.

Child IS receiving a benefit through dad’s SSDI – those child benefits are based on the parent’s eligiblity.

You’re not going to be able to “double dip”.
